RL ENERGY COMPANY, an Oklahoma Corporation, and, RUSSELL E. MINER, and, ELVIN EARL MINER, if living, or if deceased the UNKNOWN SUCCESSORS of such deceased person, Defendants. Case No. CJ-2018-69 NOTICE BY PUBLICATION THE STATE OF OKLAHOMA TO: RL ENERGY COMPANY; and, RUSSELL E. MINER; and, ELVIN EARL MINER, if living, or if deceased the UNKNOWN SUCCESSORS of such deceased person; GREETINGS: YOU, and each of you, are hereby notified that you have been sued by the Plaintiff who filed its Petition against you in the above styled cause of action in which said Plaintiff alleges that a certain oil and gas lease covering the following described real property, to-wit: The Southwest Quarter of the Northwest Quarter (SW/4 NW/4) of Section Seven (7), Township Nineteen North (19N), Range One West (1W) of the Indian Meridian, County of Payne, State of Oklahoma; has expired and terminated, that the equipment thereon has been abandoned by you and the other Defendants and declaring the equipment situated thereon abandoned; Said Petition prays that a Judgment be entered by the Court, inter alia, decreeing: a) That a certain oil and gas lease described in the Petition be set aside, canceled and held for naught; and, b) That the title of the Plaintiff be quieted in the subject real property and the oil, gas and other minerals lying thereunder; and, c) That the Court determine that all the equipment situated on the subject real property, including, not limited to, the tank battery, separator, saltwater tank, and the wellbore with all casing, tubing and all the pipe and connections associated therewith has been abandoned by the operator and the former owners thereof; and that the full and complete title thereto, by virtue of said abandonment, be decreed to have vested in the Plaintiff; or, d) In the alternative, that in the event that said equipment has not been abandoned by the owners thereof, the Plaintiff be allowed damages thereon for the use of the surface of the subject real property as the same constitutes a trespass in a sum in excess of $10,000.00 YOU, and each of you, are hereby further notified that you must answer said Petition on or before the 23rd day of March, 2018, or the allegations contained therein will be taken as true and judgment will be entered against you in accordance with the prayer of said Petition.
